2 Acceptance of these terms

By accessing access-air-bility.com or any sub-domain (the “Site”), purchasing a report, subscribing to content or submitting a survey, you agree to be bound by these Terms. If you do not accept them, stop using the Site.

3 Changes

We may update these Terms at any time. Material changes will be flagged on the Site; continued use after the change date constitutes acceptance.

4 Our services

• Free content: Blog articles and other resources not listed below.

• Paid PDF reports: One-off downloads (minimum price £199).

• Subscription Service: Periodic reports and/or dashboard access (launching soon).

• Client dashboard (beta): Password-protected sub-domain showing a client’s own aggregated performance data.

5 Orders, payment and cancellation

5.1 Prices are in GBP; we are not VAT-registered. Prices are therefore treated as VAT-exclusive.

5.2 Payment is processed via Stripe or WooCommerce at checkout.

5.3 Business customers only. By ticking the Business Use box at checkout you confirm you are purchasing wholly or mainly for business purposes; statutory consumer cooling-off rights do not apply.

5.4 All sales are final. We may issue goodwill refunds at our discretion but are not obliged to do so.

5.5 We may cancel an order (with full refund) if we suspect fraud, misuse or technical error.

6 Licences & intellectual-property rights

6.1 We own all intellectual property in the Site, reports and dashboard (“Materials”).

6.2 On payment we grant you a non-exclusive, non-transferable licence to use the Materials internally within your organisation. You may reproduce small excerpts (≤ 250 words or one screenshot) for internal presentations within the licensee’s organisation if credited “© Access-air-bility”. No external publication, resale or distribution without our written consent.

6.3 You must not scrape, data-mine, send automated high-volume requests to or reverse-engineer the Site or dashboard.

7 User submissions (surveys)

By submitting a survey you:

• confirm your answers are accurate to the best of your knowledge;

• grant us a perpetual, royalty-free right to use your answers (once anonymised) for research and commercial reporting; and

• acknowledge processing is governed by our Privacy Policy.

8 Availability & service level

8.1 Beta dashboard SLA: 95% monthly uptime (08:00–20:00 UK). Planned maintenance and force-majeure events are excluded.

8.2 Service-credit remedy: if monthly uptime falls below 95%, you may claim a service-credit equal to the downtime hours. Claims must be made within 30 days of the month-end and the credit will extend your subscription; this is your sole and exclusive remedy for downtime.

8.3 Blog, survey forms and report downloads are provided “as available” with no uptime guarantee.

9 Disclaimer – informational nature

Reports and dashboard metrics are informational only. They are not operational, safety or investment advice and should not be your sole basis for critical decisions. Beta features may change or be withdrawn without notice.

10 Accessibility commitment

We aim for WCAG 2.1 AA compliance on our core Site. Third-party plugins and external links are outside our control. If you encounter an accessibility barrier, email us; we maintain an accessibility-complaints log and will, where feasible, remedy issues within a reasonable time. No liability is accepted for temporary non-conformance.

11 Limitation of liability

Except for (i) death or personal injury caused by our negligence, (ii) fraud, or (iii) any liability that cannot legally be limited:

• All implied warranties are excluded.

• We are not liable for indirect, special or consequential loss, or for loss of profit, data or goodwill.

• Our total liability for all claims in any 12-month period is capped at the fees you paid to us during that period.

Nothing in these Terms limits any liability that cannot lawfully be limited.

12 Indemnities

12.1 Your indemnity: you will indemnify us against all claims, losses, damages, costs and regulatory fines arising from your (or your users’) misuse of the Materials, breach of these Terms or attempts to re-identify individuals from anonymised data.

12.2 Our indemnity: we will defend and indemnify you against third-party claims that the Materials, when used in accordance with these Terms, infringe any UK intellectual-property right, provided you promptly notify us and allow us sole control of the defence and settlement.

13 Termination

We may suspend or terminate your dashboard or Subscription Service access immediately for material breach of these Terms; no refund will be due.

14 Governing law & jurisdiction

These Terms are governed by English law. The courts of England & Wales have exclusive jurisdiction over any dispute.

15 Miscellaneous

If any clause is unenforceable, the remainder continues in effect. You may not assign your rights without our consent; we may assign ours on notice. No waiver of breach operates as a waiver of future breaches.
